The Promotion is sponsored and administered by Royal Fiberglass Pools/Mueller Farms Landscaping Company (“Sponsor”). ELIGIBILITY: The Promotion is open only to legal residents of New York and homeowners, living in the counties of: Cayuga, Chenango, Cortland, Herkimer, Jefferson, Madison, Lewis, Onondaga, Ontario, Oswego, Otsego, St. Lawrence, Schuyler, Seneca, Tompkins, Wayne, Yates, Oneida E, Oneida W, Cortland, Broome, Tioga and Chemung. You must be 18 years of age or older at the time of entry. Sponsor’s employees, its parent companies, affiliates, subsidiaries, advertising, promotion and production agencies, and their employee’s immediate family members and persons living in the same household of each, are not eligible to enter. Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law. The winning Homeowner must be able to provide accessibility and the site must be capable of accommodating installation of a 13’ X 30’ pool. Homeowner will be responsible for providing all necessary permits. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A Purchase will not improve your chance of winning. There are two ways to enter: (1) Enter on-line at either www.wtvh.com, or wbngtv.com by following the on-screen instructions, (2) Complete an entry at the Royal Fiberglass Pool location located at 513 Route 281, Tully ,NY 13159. All on-line entrants must have a valid e-mail address. Sponsor is not responsible for entries, claims, affidavits or notices that are lost, illegible, late, damaged, incomplete or arrive with postage due. Sponsor may prohibit you from participating in the Promotion if, at its sole discretion, you attempt to circumvent these Official Rules, or act: (a) in a manner that affects the administration, security, fairness or proper play or conduct of the Promotion in any way; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive manner. All entries shall become property of Sponsor and may not be acknowledged or returned. PRIZES: The following Prize will be awarded pursuant to these Rules: 1. Royal Fiberglass Pools of N.Y., Inc. will supply and install a one piece fiberglass pool manufactured by Specialty Fiberglass Pools. It is a 13 X 30 outside dimension Roman shaped pool that is 3’ – 6’ in depth. This pool will be fully installed in normal ground conditions with accessibility into the homeowners’ yard for excavating equipment and the pool. Installation of the fiberglass pool will include leveling, backfilling, plumbing of the pool and filter, rough grading, and all necessary plumbing. Plumbing includes 200 feet of spa pipe and equipment located within 20 feet of pool, any additional plumbing or footage will incur an up-charge. All applicable taxes including federal and state income tax are the sole responsibility of the Winner. The Prizes may not be sold, transferred and are not convertible to cash. WINNER SELECTION: Sponsor’s will randomly draw winning entry from all entries received by the Sponsor as of 5 pm on May 30, 2008. In accepting a prize, the winner must submit to a site survey by Royal Fiberglass Pools within 5 days. The winner must meet all requirements as stated in eligibility. If the winner does not meet these eligibility requirements then process is continued to suitable winner is declared. In accepting prize, the winner accepts to take the prize as outlined in such promotion. All prizes are subject to the expiration dates and rules by the prize donor. If winner is not able or chooses not to accept prize “as is”, winner forfeits his/her prize. Any forfeited prize will not be reissued during this Promotion. AFFIDAVITS: As a condition of being awarded a prize, Winner will be required to execute and deliver to Sponsor within ten (10) days of notification, a signed Affidavit of Eligibility, Publicity Release, Release of Liability. Failure to return these documents within the specified period will result in automatic forfeiture of the prize. Except where prohibited by law, prize acceptance constitutes permission to use Winner's name, address, images and/or likeness for purposes of advertising and promotion in any media, including on-line worldwide, without limitation or further compensation. RELEASES AND GENERAL CONDITIONS: By entering the Promotion, participants agree: (a) that by submitting an entry, they irrevocably authorize the Sponsor and its designees to use and broadcast his or her name on the air without compensation or breach of any rights of publicity under the law (b) to be bound by these Official Rules, available on-line at www.wtvh.com, by mail to the Sponsor or at Sponsor’s location and all decisions of the Sponsor shall be final and binding, and (c) that the Sponsor, its parent and affiliate companies, their advertising or promotional agencies, and their respective officers, directors, attorneys, agents, and employees are not responsible for and shall not be liable for (1) any design, printing, typographical, or other errors, omissions, deletions, or defects, in any material associated with the prizes or Promotion; (2) illegible, incomplete, damaged, misdirected, late, lost, postage due, undelivered, or unprocessed entries; (3) any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Website, through the mail or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion; (4) any condition caused by events beyond the control of the Sponsor which may cause the Promotion to be disrupted; and (5) any claims, loss, injury, expense or damage of any kind caused by participation in this Promotion, or by the acceptance and/or use of the prizes. In the event a dispute arises regarding an on-line entry made by a specific individual entitled to receive a prize, entry will be declared made by the “authorized e-mail account holder” and any damage made to the Website will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend all or any portion of this Promotion should fraud, failures or difficulties, computer viruses or bugs, tampering, unauthorized intervention or other causes beyond the control of the Sponsor and its agencies affect the administration, fairness or proper play or conduct of the Promotion. All entries received on-line before the on-line portion becomes inoperable, will be included in the random drawing. Any attempt by an entrant to deliberately damage the Promotion Website or undermine the legitimate operation of the Promotion may be in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek remedies and damages, including attorney’s fees, from any such entrant to the fullest extent of the law.
