The New York State Police in Marcy investigated a 2 Car Fatal Motor Vehicle Accident that occurred on 06/24/08 at 7:57 PM on River Rd in the Town of Marcy, Oneida County, NY. A 2007 BMW operated by Radoslaw M. Krakowiak , age 25, of Utica, NY was traveling west on River Rd. when he failed to keep right entering the eastbound lane, striking a 2005 Toyota head on. The Toyota was being operated by Rosemary J. Kauth, age 72, of Utica. Kauth was transported to St. Elizabeth's Medical Center, then later transported to University Hospital in Syracuse, NY where Rosemary Kauth succumbed to her injuries. Radoslaw M. Krakowiak was charged with Aggravated DWI, Vehicular Manslaughter first, and other vehicle and traffic charges. Radoslaw M. Krakowiak had a blood alcohol content of .22. Krakowiak was arraigned in the Town of Marcy court where he was remanded to the Oneida County Jail in liew of $50,000 cash and $100,000 secured bond. The State Police were assisted at the scene by members of the Oneida County Sheriff's Dept and the Maynard Fire Department, the investigation is continuing.
